Can a Florida HOA move your solar panels to a different roof plane?

Florida law limits how an association may control rooftop solar placement. Compare the requested location with the statute and the system design before installation.

THE SHORT ANSWER

Florida Statute 163.04 says an association may determine a rooftop location within 45 degrees east or west of due south only if that choice does not impair effective operation. That is a design question, not permission to skip the association process. [1]

Save the exact request

Keep the current architectural guidelines, your submitted layout and the association’s written response. “Move the panels to the back” is not enough detail for a technical review. Mark the requested roof plane and ask whether the association is relying on a particular rule. Do not revise a signed proposal from a phone summary.

Measure the effect before arguing about it

Ask the designer to compare usable area, orientation, pitch and shade for the proposed and requested locations. The statute uses an effective-operation standard; a sales preference or curb-appeal opinion does not calculate the change. Request a dated layout and production estimate for both configurations when the difference could affect the project.

Keep approvals in separate lanes

An association decision does not replace a building permit, utility interconnection review or equipment-owner approval. Likewise, a utility application does not answer an association question. Track each item with its own status and decision maker so one approval is not presented as evidence that every other review is complete.

Escalate legal questions appropriately
